Terms of Service

#1. Purpose

These terms ("Terms") govern the use of the wheremyflow service ("the Service") published by Frédéric GAVEAU EI ("the Publisher"), 6 rue du Château, 12190 Estaing, France.

By subscribing to the Service, the Customer ("you") accepts these Terms unreservedly.

#2. Description of the Service

The Service is a hosted web audience measurement solution, compliant with the EU GDPR and ePrivacy directive, and with the national frameworks of the main EU markets covered: 🇫🇷 CNIL (July 2025), 🇩🇪 DSK (TDDDG §25), 🇮🇹 Garante (art. 122 Codice Privacy), 🇪🇸 AEPD (LSSICE 22.2), 🇳🇱 AP (Telecomwet 11.7a). It allows the Customer to analyse traffic on their website without cookies or persistent identifiers.

The Publisher acts as a data processor within the meaning of article 28 of the GDPR; the Customer remains the data controller. A standard Data Processing Agreement (DPA), compliant with GDPR article 28, is incorporated into these Terms.

#3. Subscription, trial period and billing

#3.1 Trial period

The Service is freely accessible for 30 days without entering a payment method. At the end of the trial, access is suspended unless a paid plan is subscribed.

#3.2 Plans and prices

Plans, pageview tiers and prices are published on the pricing page. Prices are stated excluding tax. VAT is added based on the Customer's country (VIES validation for business customers).

#3.3 Payment

Payment is made by bank card or SEPA transfer via the Mollie B.V. (Netherlands) payment service provider, an authorised payment institution. The Publisher never has access to the Customer's card details.

#3.4 Invoicing

Invoices are issued monthly and accessible from the billing portal. The Customer can download invoices in PDF format.

#4. Commitment and termination

#4.1 No fixed term

All plans are without fixed term commitment. The Customer may cancel at any time from the billing portal.

#4.2 Effect of cancellation

Cancellation takes effect at the end of the current billing period. No automatic prorated refund is granted.

#4.3 Data deletion

Upon cancellation, the Customer's data is retained for 30 days for possible recovery, then irreversibly deleted (cascading purge of raw events, aggregates, and export logs). The Customer can request immediate deletion via the Erase site function in the Compliance tab.

#5. Quotas and overage

Each plan includes a monthly pageview quota. In case of overage, the Customer is notified by email at thresholds 80 %, 100 %, 120 %, 150 % and 200 %. Beyond 200 %, the Publisher reserves the right to propose a plan change or a temporary suspension after reasonable notice. Occasional spikes (viral effect, campaign) may be reviewed case-by-case — contact support.

#6. Availability and support

The Publisher commits to reasonable efforts to keep the Service available. No contractual uptime SLA is provided outside of the Enterprise plan. Support is provided by email at contact@wheremyflow.com, with a target first response within 24 business hours (Monday to Friday, 9 a.m.–6 p.m. Paris time).

#7. Property and licences

#7.1 Customer data

Data collected by the Service on the Customer's site remains the Customer's exclusive property. The Publisher never appropriates this data and never uses it for any purpose other than providing the Service.

#7.2 Service

The Customer is granted a non-exclusive, non-transferable right of use of the Service, limited to the subscription term.

#8. Liability

The Publisher cannot be held liable for:

• failures of the Customer's or their providers' internet connection,
• non-compliant use of the Service by the Customer (in particular installing the tracker on an unauthorised site),
• indirect loss of revenue or data.

The Publisher's total liability, for any cause whatsoever, is capped at the amounts paid by the Customer during the 12 months preceding the triggering event.

#9. Personal data and confidentiality

The processing of personal data is governed by the privacy policy and the DPA.

#10. Amendments

The Publisher may amend these Terms by notifying Customers 30 days before they take effect. The Customer may cancel at no cost if they refuse the new terms.

#11. Governing law and jurisdiction

These Terms are governed by French law. Any dispute falls under the exclusive jurisdiction of the French courts of Rodez (Aveyron). Consumer Customers retain the benefit of mandatory protection rules.
